Terms of Service — Kluge
Effective date: [EFFECTIVE DATE] Last updated: 2026-08-26
⚠️ DRAFT — NOT YET REVIEWED BY A LAWYER. Not legal advice. The disclaimer and liability sections in particular are the ones that actually matter if something goes wrong, and their enforceability varies by jurisdiction — especially against minors, who in many places cannot form a binding contract. Have counsel review before publishing. Placeholders in [BRACKETS] must be filled in.
1. Agreement
By using Kluge ("the app"), you agree to these terms. If you don't agree, don't use the app. The app is provided by [LEGAL ENTITY NAME] ("we", "us").
2. Who can use it
You must be at least 13 years old to use Kluge. The app does not ask your age or verify it, so this is a condition of use that you are agreeing to by signing in.
If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian, who agrees to these terms on your behalf.
If we learn that an account belongs to someone under 13, we will delete it.
3. Your account
Sign-in is by phone number and a one-time code. You are responsible for keeping access to that phone number secure, and for activity under your account. Tell us at [CONTACT EMAIL] if you think someone else is using it.
Don't create accounts by automated means, share your account, or use someone else's phone number.
4. What the app is — and what it isn't
Kluge helps you explore and compare US colleges using published data.
It is not admissions advice, and it does not predict admissions outcomes. Match scores, comparisons, and recommendations are informational aids produced by software from public datasets. They are not a professional judgment about your chances anywhere, and they are not a substitute for your school counsellor or the admissions office at the college itself.
Always confirm anything that matters — deadlines, requirements, testing policies, costs — directly with the institution. Data may be out of date, incomplete, or wrong.
5. Accuracy and data sources
The app draws on federal datasets (IPEDS, College Scorecard, PSEO), material published by state systems, and information compiled from institutional websites. We make no warranty that any of it is accurate, current, or complete. Costs and admissions figures in particular change every cycle and are often reported on a lag of a year or more.
Recommendations and search interpretation use automated language models. Model output can be wrong or misleading and should be treated as a starting point.
6. Acceptable use
Don't:
- scrape, bulk-download, or systematically extract the app's data;
- reverse-engineer, decompile, or attempt to defeat access controls;
- abuse the sign-in system, including sending codes to numbers that aren't yours;
- overload or interfere with the service, or attempt to reach data that isn't yours;
- submit unlawful, abusive, or infringing content through feedback or notes;
- use the app to build a competing product or dataset.
7. Your content
You keep ownership of what you write — your notes and feedback. You grant us a licence to store and process it to operate the app, and to use feedback to improve the product. Don't submit anything you don't have the right to submit, or anything you wouldn't want us to read.
8. Our content
The app, its design, and its compiled datasets are owned by us or our licensors and are protected by intellectual-property law. Underlying federal datasets are public domain and remain so. College names, logos, and marks belong to their institutions and are used to identify those institutions; use in the app is not endorsement or affiliation.
Campus photographs sourced from Wikimedia Commons are used under their respective Creative Commons licences and are credited in the app.
9. Availability and changes
We may change, suspend, or discontinue any part of the app at any time. We may update these terms; material changes will be notified in the app before taking effect, and continuing to use the app after that means you accept them.
10. Ending it
You can stop at any time — delete your account in Settings, or delete the app. We may suspend or terminate an account that breaches these terms.
11. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We don't warrant that the app will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost opportunities — including any admissions, enrolment, financial-aid, or educational outcome connected to your use of the app.
Our total liability for any claim is limited to [LIABILITY CAP — e.g. USD 100, or amounts paid in the preceding 12 months].
Some jurisdictions don't allow these exclusions, so parts may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.
13. Governing law and disputes
These terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules. Disputes will be resolved in the courts of [VENUE].
[DECISION REQUIRED: whether to include an arbitration clause and class-action waiver. These are commonly unenforceable against minors and are increasingly restricted — take advice rather than copying another app's.]
14. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is a third-party beneficiary of these terms and may enforce them.
